Danone Wins Legal Battle Over "Carbon Neutral" Label on Evian Bottles.

Danone, the producer of Evian spring water, has successfully had a lawsuit dismissed that challenged its claim of being "carbon neutral" on its product labels. The case, which was brought forward by U.S. consumers, alleged that the company misled customers by promoting Evian as environmentally friendly while continuing to emit carbon dioxide during its production process.

 

On January 10, U.S. District Judge Nelson Roman, based in White Plains, New York, ruled that the term "carbon neutral" used on Evian bottles was ambiguous. Judge noted that Danone's labeling might have given consumers "unreasonable expectations" regarding their ability to interpret the claim accurately. As a result, the judge overturned an earlier decision that allowed the class-action lawsuit to proceed, effectively dismissing the case.

The plaintiffs, Stephanie Dorris from California and John Axiotakis from Massachusetts, argued that they had paid a premium for Evian, believing the "carbon neutral" label indicated the product’s environmental credentials. However, they alleged that Danone failed to disclose that its production process still contributed to carbon emissions. The attorneys representing the plaintiffs did not immediately respond to requests for comment.

This ruling follows a similar decision in Chicago, where a federal judge dismissed a lawsuit against Danone over its "natural" labeling of Evian. The case argued that the presence of microplastics, which can leach from plastic bottles, contradicted the product’s "natural" claim.

The court's decision permits the plaintiffs to submit a second amended complaint, indicating that further legal action may still be pursued. For now, Danone can continue to market Evian as "carbon neutral," but the case underscores ongoing scrutiny of environmental claims made by corporations.
