Alec Baldwin's Involuntary Manslaughter Charges Dismissed.
Alec Baldwin will not be required to appear in court again regarding the involuntary manslaughter charges stemming from a fatal shooting on the set of Rust, following the decision by New Mexico prosecutors to withdraw their appeal. Earlier this year, the trial against Baldwin was halted after only three days due to revelations that prosecutors had withheld potentially exculpatory evidence from the defense.
Baldwin was in possession of a firearm that discharged on the New Mexico set in 2021, resulting in the death of cinematographer Halyna Hutchins and injuries to director Joel Souza. The 66-year-old actor and co-producer has consistently maintained that he did not pull the trigger and was instructed to point the weapon at a camera. After the trial concluded, special prosecutor Kari Morrissey initiated an appeal, asserting that the case had been "improperly dismissed" by Judge Mary Marlowe Sommer.
On Monday, the district attorney's office for the state announced that, despite their strong disagreement with the judge's ruling, they "did not intend to exhaustively pursue the appeal." Local prosecutors further stated: "Consequently, the State's attempts to continue litigating the case in a fair and thorough manner have encountered numerous obstacles that have hindered its ability to prosecute to the fullest extent of the law." Baldwin's attorneys, Luke Nikas and Alex Spiro, remarked that this decision "serves as the final vindication of what Alec Baldwin and his legal team have asserted from the outset - this was an unspeakable tragedy, but Alec Baldwin committed no crime."
As a result, Judge Marlowe Sommer's initial ruling, which dismissed the involuntary manslaughter charges against Baldwin and prohibits any future filings, remains in effect. The case unraveled when Baldwin's defense team discovered that the Santa Fe sheriff's office had seized live ammunition as potential evidence on the same day that the film's armorer, Hannah Gutierrez, was convicted of involuntary manslaughter. These live rounds were not included in the Rust case file and were not disclosed to the defense attorneys, leading to a motion for dismissal of the case.
On the third day of the trial, following Mr. Spiro's assertion that evidence had been hidden, Ms. Morrissey took the stand as a witness and stated that the ammunition was unrelated to the case. The decision to drop the appeal effectively ends the legal proceedings against Alec Baldwin regarding the 2021 Rust shooting. Despite controversy and the tragic loss of Halyna Hutchins, Baldwin's legal team maintains his innocence, marking a significant development in the case, with no further charges expected.
