The North American seafood industry is facing an unprecedented lawsuit that could change the way the $25 billion sector operates. For the first time in history, a lawsuit is challenging human trafficking and forced labor within the industry.

The case has been brought against US seafood giant Bumble Bee Foods, alleging that the company knowingly benefitted from forced labor and human trafficking in its tuna supply chain. The suit could have far-reaching consequences for the seafood industry as a whole.

The Allegations: Forced Labor and Human Trafficking

Filed under the Trafficking Victims Protection Reauthorization Act (TVPRA), the lawsuit was initiated by a group of fishers in San Diego, California. They claim that they were subjected to forced labor and human trafficking while catching tuna that ultimately ended up being sold by Bumble Bee Foods in the US.

The lawsuit alleges that these workers endured hazardous working conditions, including untreated injuries, excessive working hours, and emotional abuse, while at sea.

Personal Accounts of Abuse at Sea

The plaintiffs in the case have shared harrowing personal stories. One of the complainants, Akhmad, describes a traumatic experience where he sustained a serious leg injury while working on a fishing vessel.

Despite the severity of the injury, he was told to continue working without receiving medical treatment. This personal account sheds light on the appalling conditions faced by fishers who, according to the lawsuit, were effectively trapped in a cycle of abuse, working in dangerous conditions with little hope of escape.

Bumble Bee Foods’ Alleged Role in Human Rights Violations

The lawsuit accuses Bumble Bee Foods of benefiting from the forced labor and human trafficking within its supply chain. The plaintiffs argue that Bumble Bee knew—or should have known—about the exploitative conditions on the fishing vessels but continued to profit from them.

Alleged abuses include physical violence, debt bondage, excessive working hours, financial threats against workers' families, and the denial of adequate food and medical care. The suit claims that the company has failed to ensure fair treatment of workers and has ignored the human rights violations happening under its watch.

A Global Problem: Forced Labor in the Seafood Industry

The case against Bumble Bee Foods is part of a much larger issue facing the global seafood industry. According to a 2022 report from the International Labour Organisation, 128,000 fishers around the world are victims of forced labor.

The isolation of working on fishing vessels, which often stay at sea for months at a time, creates the perfect conditions for abuse. The lawsuit also highlights the connection between forced labor and illegal, unreported, and unregulated (IUU) fishing, which further damages fish stocks and depletes the oceans.

The global seafood market is worth over $350 billion, and Bumble Bee Foods is one of the largest players in the US canned tuna market, controlling about 25% of the market share.

This case is also drawing attention to Fong Chun Formosa, Bumble Bee’s Taiwanese parent company, which oversees much of the tuna supply chain. The case serves as a warning for other companies in the seafood sector to take greater responsibility for ensuring ethical practices within their supply chains.

The Industry Must Change: Advocates Call for Accountability

Environmental and human rights advocates are calling for a significant shift in the way the seafood industry operates. Arifsyah Nasution, global project lead at Greenpeace Southeast Asia, emphasized that this lawsuit is a wake-up call for the industry.

He urged Bumble Bee Foods and other seafood companies to stop ignoring human rights abuses within their supply chains. "The time to put an end to these atrocities is now," Nasution said, underscoring the need for widespread reform to protect vulnerable workers.

This lawsuit is not just about one company—it is a broader call for accountability across the entire seafood sector. The plaintiffs are seeking justice for themselves and others who are trapped in similar exploitative situations. Their efforts could pave the way for significant changes in the way the industry handles labor rights and environmental protections.

Bumble Bee Foods has faced legal issues in the past. One notable case was in 2017, when the company was involved in a major price-fixing scandal. Bumble Bee Foods, along with two other major tuna companies—StarKist and Chicken of the Sea—was accused of conspiring to fix prices for canned tuna products in the U.S. market.

The U.S. Department of Justice filed charges against Bumble Bee and its executives, resulting in the company agreeing to pay a $25 million fine to settle the charges.

In addition, some of Bumble Bee's former executives were convicted and sentenced for their roles in the price-fixing conspiracy. The scandal raised concerns about corporate practices in the seafood industry and led to closer scrutiny of the company's operations.
