Starbucks Widely Violated Law in Washington, Labor Judge Finds.

A judge from the National Labor Relations Board (NLRB) determined that Starbucks breached labor regulations both prior to and following the unionization of employees at various locations in Washington State in 2022.

The company was found to have violated the law by implementing unjust rules, monitoring employees, and discarding union-related materials. This ruling responds to grievances from workers in Olympia, Seattle, and Everett, Washington. The judge concluded that Starbucks improperly prohibited employees from engaging with journalists, disposed of union flyers in break areas, and enforced a dress code in a discriminatory manner against union advocates. Additionally, the dress code unlawfully restricted employees from displaying union pins.

The judge mandated that Starbucks revoke these policies and compensate two employees for wages lost due to being sent home prematurely. This case arises amidst ongoing conflicts between Starbucks and the union, which has been conducting strikes and alleging that the company has failed to present reasonable proposals during contract discussions. Employees at select Starbucks locations nationwide have been organizing job actions during the busy holiday season, asserting that Starbucks has not made a genuine effort to resolve the ongoing dispute.

In a ruling that spanned over 100 pages, NLRB Administrative Law Judge John Giannopoulos found substantial evidence supporting nearly all claims of unfair labor practices. Giannopoulos instructed Starbucks to annul the unlawful policies and provide compensation to two baristas for their lost wages after being sent home early.

The NLRB ruling against Starbucks underscores the company’s labor challenges as unionization efforts grow nationwide.
