Texas AG Ken Paxton Fights for Age Verification on Adult Websites.

Texas Attorney General Ken Paxton is continuing his legal battle to uphold the state’s age verification law aimed at protecting minors from accessing explicit content online. In 2023, the Texas law, which mandates adult websites to verify the age of users before granting access to explicit material, faced significant opposition and legal challenges.

In November 2023, the U.S. 5th Circuit Court of Appeals lifted an injunction that had previously blocked the law, allowing Texas to proceed with its enforcement. This ruling marked a pivotal moment in the ongoing legal fight. Texas Attorney General Ken Paxton quickly seized the opportunity to file a lawsuit against Aylo Global Entertainment, a major player in the adult content industry that operates large platforms, including Pornhub.

“Texas has a right to protect its children from the detrimental effects of pornographic content,” said Paxton. “I look forward to holding any company accountable that violates our age verification laws intended to prevent minors from being exposed to harmful, obscene material on the internet.”

Following this lawsuit, Paxton expanded his legal efforts by suing two more adult entertainment companies—Multi Media, LLC and Hammy Media—for violating the state's age verification law. These actions signal Texas' firm stance on safeguarding minors and upholding state laws designed to regulate online content.

Despite widespread support from advocates for child protection, critics warn that such laws may infringe on privacy and First Amendment rights. Ezra, a legal expert, expressed concerns about the government’s ability to track personal access to controversial material, saying, "People will be particularly concerned about accessing controversial speech when the state government can log and track that access.

By verifying information through government identification, the law will allow the government to peer into the most intimate and personal aspects of people’s lives."

Texas' age verification law, enacted in 2023, requires adult websites to verify users' ages before allowing access to explicit content, aiming to protect minors from harmful material online. After a U.S. District Judge blocked the law, the 5th Circuit Court of Appeals lifted the injunction in November 2023, allowing Texas to enforce it. Attorney General Ken Paxton has filed lawsuits against major pornographic companies for violating the law.

The law is part of a broader trend, with other states like Utah and Kansas introducing similar measures. Critics, including legal expert Ezra, argue that it could infringe on privacy and enable government surveillance of sensitive material access. Supporters contend it is essential for safeguarding children from online dangers. The U.S. Supreme Court is expected to review the case, which has sparked significant debate about privacy and regulation.
