A proposed settlement has been reached in a class action lawsuit concerning a Data Security Incident involving Bryan Cave Leighton Paisner LLP (“BCLP”) and Mondelēz Global LLC (“Mondelēz”). On or about February 27, 2023, BCLP became aware of potential unauthorised access to their systems and data due to a security breach. An investigation revealed that a threat actor had accessed files containing personally identifiable information (PII) and protected health information (PHI) related to clients of both BCLP and Mondelēz, including Chicago IVF.
The breach exposed sensitive data such as names, Social Security numbers, dates of birth, employee IDs, and health-related information. The settlement resolves a lawsuit where plaintiffs allege that the breach compromised this personal and health data.
While Bryan Cave Leighton Paisner and Mondelēz deny all allegations of wrongdoing, they have agreed to settle in order to avoid the costs and burden of further litigation. This settlement does not constitute an admission of liability.
What Does the Settlement Offer?
The settlement provides Settlement Class Members with the following benefits:
- Credit Monitoring and Identity Theft Protection Services: All Settlement Class Members are eligible for up to three years of credit monitoring and identity theft protection services.
- Additional Benefits: In addition to the above, Settlement Class Members can choose one of the following options:
- Reimbursement for Out-of-Pocket Losses and Lost Time: Settlement Class Members can claim compensation for documented out-of-pocket losses up to $7,000. Additionally, members can be reimbursed for lost time up to five hours, paid at a rate of **$25 per hour.
- Alternative Cash Payment: Members can opt to receive a pro-rata share of the Residual Settlement Fund.
Key Deadlines and Your Options
If you are a Settlement Class Member, you have the following rights and options:
- Submit a Claim Form: To receive cash and/or other benefits, you must submit a valid and timely claim form by February 10, 2025. You can submit your claim online at www.BCMDLZSettlement.com or download the claim form and mail it to the settlement administrator.
- Do Nothing: If you choose not to participate, you will receive no payment, and you will no longer have the right to sue Bryan Cave Leighton Paisner or Mondelēz regarding the claims covered by this settlement. You will be bound by the terms of the settlement.
- Exclude Yourself: If you wish to opt-out of the settlement and retain the right to sue separately, you must exclude yourself by January 13, 2025. Instructions on how to exclude yourself are available on the website.
- Object: If you do not wish to exclude yourself but want to object to the settlement, you must submit your objection to the court by January 13, 2025. Even if you object, you must still submit a claim form to receive any monetary relief.
- Attend the Hearing: You can attend the final approval hearing on January 21, 2025, at 11:00 AM CT. The court will decide whether to approve the settlement and hear any objections. You may request permission to speak about your objection at the hearing.
Court Approval and Next Steps
The settlement will only take effect once the court gives its final approval, which has not yet occurred. No payments will be made until the settlement is approved, and any appeals are resolved.
